Last week, the Alabama Court of Criminal Appeals overruled an Application for Rehearing in an appeal filed by Marcus Goode.
Goode, 28, of Opp filed the appeal after his probation was revoked in June 2024.
Goode was on probation after serving time in prison on an second degree escape charge. In that case, Goode fled from officers while he was serving a sentence in the Opp City Jail. After being released from prison in that case, Goode was ordered to complete a supervised probation term.
While on probation, Goode was arrested for public lewdness by Opp Police Department Officer Lee Edgar, who was on duty when a call came in that a man was walking around a residential neighborhood naked. When Edgar arrived, Goode ran from him, through the woods, and through several backyards in the area.
Erin Wilson, a longtime employee of the District Attorney’s Office and a third-year law student authorized to practice law, represented the State at the probation revocation hearing.
“This was my very first hearing, and it was a fact pattern — and courtroom experience — that I’ll never forget,” Wilson said.
“This was the third time Goode had been in court for his failure to comply with probation on this case,” said District Attorney Walt Merrell. “He had every opportunity to turn his life around but chose not to. It was time he was held accountable for his actions. Officer Edgar made a good arrest and made it possible for Goode to be off the streets, unable to torment the neighborhood any longer.”
After the probation revocation hearing, Judge Lex Short revoked Goode’s probation and sentenced him to serve the remainder of his sentence in prison.
“I appreciated the work of the Alabama Court of Appeals, and I was glad to see them affirm Goode’s sentence in December of 2024. Their stamp of approval on my very first hearing is something I’ll always remember,” Wilson said.
